As part of the Barwon Heads Road Duplication Project, a number of rural residential and urban growth zoned properties were partially acquired to facilitate the Stage 1 of the Project.

We were engaged by a number of Lawyers, acting on behalf of Claimants, to provide an independent assessment of the compensation payable to landowners who had their properties partially acquired due to the Project.

We utilised the ‘Before and After’ methodology, as per Section 41(3) of the Land Acquisition and Compensation Act (LACA). This method calculates compensation as the difference between the property’s value before the acquisition, ignoring any impact from the Project, and its value after, considering all impacts arising as a direct consequence of the acquisition.

We analysed the acquisition’s implications on the remaining land and the negative impacts of a road widening. The compensation assessments included a ‘severance’ allowance, accounting for the reduced utility and value of the land due to the a change in traffic conditions and reduced liveability.
